MOTION by Mark Sammut, SECOND by Jeff Pauza, to approve the June 21, 2017 minutes with correction to Page 5, sentence beginning “ There was agreement...” - change to read: “There was a request that the Chair of the Planning Commission meet with the DRB to discuss and clarify the role of the DRB and the Planning Commission.” VOTING: unanimous (6-0); motion carried.

4. APPLICA TIONS

The function of the Development Review Board as a quasi-judicial board and the hearing procedure were explained. Individuals to give testimony before the DRB were sworn in.

SUB15-07R1 & DR17-04: Final Plan Amendment and Design Review to change the

recorded Final Plan (Plat) and construction of a new single family dwelling to include adjustment to the utility right-of-way from 20’ to 15’ and relocation of the water line at 624 Falls Road in the Village Residential District, Stormwater Overlay District, and Design Review Overlay District by Michael Dubois

STAFF REPORT
The DRB received a written staff report on the application, dated 7/5/17. Kate Mitchell explained the easement in the deed and on the recorded plat will be changed.

APPLICANT COMMENTS
Mike Dubois explained more room was needed for the driveway to the single family dwelling being built so the north right-of-way was reduced from 20’ to 15’. The town’s easement will not be impacted. The house with the garage and driveway are all within the required boundaries.

PUBLIC COMMENT None.

DELIBERA TION/DECISION
Final Plan Amendment & Design Review, Adjust Right-of-Way and Water Line Location for Single Family Dwelling, 624 Falls Road, Michael Dubois (SUB15-07R1 & DR17-04) MOTION by Mary Kehoe, SECOND by Mark Sammut, to finalize the record and close the hearing for SUB15-07R1 & DR17-04 (Final Plan amendment and Design Review to adjust the right-of-way and location of the water line for a single family dwelling at 624 Falls Road by Michael Dubois) and direct staff to prepare a decision indicating approval of SUB15-07R1 (Final Plan amendment) and DR17-04 (Design Review application) with the following conditions:

1. An updated Mylar shall be recorded in the Shelburne Land Records within 180 days of the signed approval of the application(s).

The easement for a future sewer line benefitting the town which extends from the existing manhole on the property in an east/northeast direction granted by the applicant shall be revised to reflect the approval.

A zoning permit shall be required prior to any improvements being made.

The new single family dwelling shall be constructed as depicted in the

elevations submitted with materials and modifications as noted on the New

House Materials List, received 6/26/17.

All previous conditions not addressed in the enumerated conditions above

shall apply.

VOTING: unanimous (6-0); motion carried.

5. OTHER BUSINESS/CORRESPONDENCE

Meeting Schedule

The August 16, 2017 DRB meeting is cancelled.
